1.2. These Terms and Conditions (Rules) are a binding legal document for the Buyer and Seller upon the Buyer’s approval (by continuing registration or ordering after reading). They define rights, obligations, delivery, returns, personal data protection, and other provisions for purchases at baboo.baby, per the Civil Code of Lithuania, Consumer Protection Law, and Electronic Commerce Directive.

1.3. Buyers must read and agree to the Rules before purchasing. Agreement is confirmed by checking the consent box during registration or ordering, forming a purchase-sale contract.

1.4. The Seller may amend the Rules, effective upon publication in the store. Buyers agree to updated Rules by checking the consent box. Orders follow the Rules version agreed at submission.

1.5. Eligible buyers include:

  • Adults with unrestricted legal capacity.
  • Legal entities.
  • Minors (14-18) with parental consent, unless self-employed.

1.6. By agreeing, Buyers confirm eligibility per 1.5.

1.7. Personal Data Protection:

  • Buyers must register or provide name, surname, email, delivery address, phone, and password.
  • Buyers consent to order-related emails.
  • Accurate data is required for purchase/delivery.
  • Buyers may opt into marketing notifications; opt-out prevents marketing use.
  • Data is shared only with delivery/service partners or per Lithuanian law.
  • Data processing follows the Seller’s Privacy Policy, integral to these Rules.

Conclusion of Contract

2.1. The contract is formed when the Buyer selects products, forms a cart, and clicks “Order” at baboo.baby. Terms match these Rules.

2.2. Product range, quantity, price, and delivery terms are binding, changeable only per these Rules.

2.3. Contracts are stored in the Seller’s database per legal requirements.

Buyer Rights

3.1. Buyers may purchase per these Rules.

3.2. Consumers (non-business buyers) may withdraw within 14 days of delivery, notifying the Seller via email (per Section 1.1). For gift card purchases, the 14-day right of withdrawal applies only to unused gift card codes, as detailed in Section 15.4.

3.3. Withdrawal doesn’t apply to:

  • Perishable/short-shelf-life goods. Custom-made goods. Unpacked goods unfit for return (health/hygiene).
  • Other cases per Lithuanian law.

3.4. Returnable goods must be undamaged, unused, with intact packaging.

3.5. Cart adjustments are allowed until shipping; withdrawal rights remain.

Buyer Oblogations

4.1. Pay and accept goods per these Rules.

4.2. Cover delivery costs if refusing goods without cause.

4.3. Update changed registration data promptly.

4.4. Secure login details; notify Seller of loss. Seller isn’t liable for third-party actions pre-notification.

4.5. Comply with Rules and Lithuanian laws, avoiding harm to the store.

4.6. Inspect goods during/at delivery, reporting issues promptly.

Seller’s Rights

5.1. Cancel registration or restrict access if Buyers harm the store.

5.2. Suspend store operations temporarily/indefinitely, executing prior orders.

5.3. Cancel orders if Buyer is unreachable for 5 days to clarify material issues, notifying via email.

Seller’s Obligations

6.1. Provide store services per these Rules.

6.2. Deliver goods per Buyer’s chosen method.

6.3. Respect Buyer’s privacy, except as legally required.

6.4. Offer alternatives or refund within 5 days if unable to deliver.

6.5. Refund within 14 days for valid returns.

6.6. Refunds require goods returned.

Prices, Order, and Payment Terms

7.1. Prices include VAT, with delivery fees added. Prices at order placement apply. Seller may change prices, effective for new orders.

7.2. Payment options:

  • Stripe

7.3. Not all payment methods are guaranteed per purchase.

7.4. Delivery starts post-payment confirmation.

7.5. Minimum cart size may apply, displayed pre-order.

7.6. Unpaid orders are canceled after 24 hours.

Delivery of Goods

8.1. Buyers provide accurate delivery address and phone number.

8.2. Buyers accept goods personally; no claims for wrong delivery if the address is correct.

8.3. Delivery by Seller or courier.

8.4. Delivery terms are preliminary; delays may occur due to shortages or unforeseen issues. Seller coordinates delays.

8.5. Seller isn’t liable for delays due to Buyer’s fault or uncontrollable circumstances.

8.6. Report damaged consignments within 24 hours.

8.7. Note packaging damage in courier documents; Seller isn’t liable otherwise.

8.8. Report defective goods within 24 hours; Seller refunds within 5 days or replaces.

8.9. Undelivered/paid goods are rescheduled; if unclaimed, order is canceled, refunding less fees.

8.10. Delivery fees are final post-order.

8.11. Buyers bear return costs for valid withdrawals.

8.12. Seller may split orders into multiple consignments.

8.13. Longest delivery time applies for mixed orders.

8.14. Changing delivery address post-shipment incurs costs; Seller isn’t liable for delays.

8.15. Seller isn’t liable for color/size discrepancies due to Buyer’s monitor.

8.17. Delivery covers Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden.

Product Quality Guarantee and Expiration

9.1. Goods carry manufacturer’s warranty, minimum per law. Poor-quality goods are repaired free per Civil Code. Seller refers Buyers to warranty centres.

9.2. Product details are in descriptions.

9.3. Seller isn’t liable for display-related discrepancies.

9.4. Legal warranty (2 years for consumers) applies if none specified. Short-shelf-life goods are marked.

9.5. Warranty doesn’t limit legal rights.

Return of Goods

10.1. Returns/exchanges follow Lithuanian regulations (Retail Trade Rules, Civil Code).

10.2. Return quality goods within 14 days, defective within warranty, via email (info@baboo.baby) and return form.

10.3. Quality goods must be:

  • In original packaging.
  • Undamaged, unused.
  • With intact labels/films.
  • Complete, with purchase document.

10.4. Defective goods don’t require packaging/appearance standards.

10.5. Return goods within 14 days post-notification; Buyer pays return costs for quality goods. Seller covers defective returns.

10.6. Defective goods refunds (including delivery) within 5 days post-return.

10.7. Quality goods refunds within 14 days post-return, excluding delivery fees, if conditions met.

10.8. Seller may reject non-compliant returns.

10.9. Use registered mail/parcel delivery for returns.

10.10. Delivery date for returns is next business day post-shipment if Buyer errors occur.

10.11. Non-compliant returns aren’t refunded; delivery negotiated.

10.12. Defective/wrong goods are replaced or refunded.

10.13. Promotional goods refund post-discount amount.

10.14. Free delivery refunds deduct shipping if conditions change.

10.15. Buyer errors incurring delivery costs are deducted from refunds.

10.16. Custom orders are non-returnable, require prepayment.

Responsibility

11.1. Buyers are liable for accurate registration data; Seller isn’t liable for errors.

11.2. Buyers are responsible for actions in the store.

11.3. Buyers secure registration data; third-party use is deemed Buyer action.

11.4. Seller isn’t liable if Buyers ignore Rules/Privacy Policy.

11.5. Seller isn’t liable for linked third-party sites.

11.6. Seller isn’t liable for non-delivery due to third-party faults or force majeure (>1 month allows contract termination).

11.7. Damages are compensated per Lithuanian law.

Exchange Law

12.1. Seller sends notices to Buyer’s registered email.

12.2. Buyers contact Seller at info@baboo.baby or via Contact us form.

Marketing Tools and Information

13.1. Seller may run/terminate promotions at any time.

13.2. Promotion terms are specified in their communications.

13.3. Buyers contact Seller at info@baboo.baby or via Contact us form.

13.4. Seller isn’t liable for undelivered messages due to network issues or Buyer errors.

Final Provisions

14.1. Seller may amend Rules, effective upon publication.

14.2. Buyers rejecting amendments lose store access.

14.3. Rules follow Lithuanian law.

14.4. Disputes are negotiated; unresolved disputes go to Lithuanian courts at Seller’s location.

14.5. Lithuanian law applies.

14.6. Consumers may contact Seller or State Consumer Rights Protection Service for disputes.

14.7. Contact Seller at info@baboo.baby; unresolved claims go to vvtat.lt or ec.europa.eu/odr within 14 days.

Gift Cards

15.1. General Provisions: BABOO® Gift Cards are issued by UAB Sentija as store credit for purchases at baboo.baby. By purchasing or using a gift card, the Buyer agrees to these terms, which supplement the general Terms and Conditions.

15.2. Purchase and Redemption: Gift cards are available in denominations of €50, €100, €150, or €200, as specified in the online store. Upon purchase, a unique coupon code for the selected amount is emailed to the Buyer’s billing email within 12 hours. Gift cards can be used to purchase any product at baboo.baby (online store only) and may be combined with active promotional codes for additional savings. The coupon code must be applied at checkout in a single transaction to deduct the gift card amount from the order total. The full gift card value must be used in one transaction; any unspent amount is forfeited and cannot be carried forward as store credit or reused.

15.3. Validity: Gift cards are valid for 6 months from the date of purchase. The expiration date is clearly stated in the gift card email. Expired gift cards cannot be used, extended, or refunded.

15.4. Consumer Rights: Per EU consumer law, Buyers may cancel a gift card purchase within 14 days of receiving the coupon code, provided the code has not been used, by notifying the Seller at info@baboo.baby (see Section 3.2). Used gift cards or codes are exempt from the right of withdrawal, as they are considered digital content activated upon use (per Lithuanian Consumer Protection Law and EU Directive 2011/83/EU). Refunds for valid cancellations are processed within 14 days of notification, excluding any delivery fees, to the original payment method.

15.5. Non-Refundable for Cash: Gift cards cannot be redeemed for cash, returned for cash refunds (except as per Section 15.4), or used to purchase other gift cards unless otherwise stated.

15.6. Liability: The Buyer is responsible for safeguarding the gift card coupon code. The Seller is not liable for lost, stolen, or unauthorized use of gift card codes, nor for replacing or refunding such codes.
